The Office of the Special Litigation Department of the Attorney General’s Office has reviewed the investigation file from the Department of Special Investigation (DSI) and issued a mixed decision in the case against The Icon Group Co., Ltd., involving 17 defendants. While charges were filed against the company and key figures, including its director Waratphon Vorattyaworakul, two individuals—Yuranan Pamornmontri (Boss Sam) and Pichaya Wattanamontri (Boss Min)—were not charged. The DSI will now evaluate whether to concur or dispute the non-prosecution order within the legal framework of the Special Case Investigation Act.
Pol. Lt. Col. Woranan Silam, spokesperson for the DSI, explained that the Attorney General's Office must send its non-prosecution decision along with supporting reasons back to the DSI. The DSI will then decide whether to agree or issue a counter-opinion. If the DSI contests the decision, the case will be forwarded to the Attorney General for a final ruling. This process must be completed within 30 days, although an extension of another 30 days is permissible.
Regarding the two acquitted defendants, Boss Sam and Boss Min, Woranan clarified that while they served as presenters for the company, evidence suggested they also acted in managerial roles and received revenue shares. The DSI initially deemed there was sufficient evidence for prosecution, but discrepancies in legal interpretations between the DSI and the Attorney General’s Office must now be reconciled.
When asked why the Attorney General’s Office overruled the recommendations of its representatives who consulted on the investigation, Woranan noted that prosecutors serving as advisors are not involved in making final prosecution decisions. The divergence of views between the DSI and the prosecutors reflects the normal course of legal review in complex cases.
