On June 17, 2025, Ms. Phatsarin Ramwong, MP for Bang Sue-Dusit from the People’s Party, posted on Facebook that the Administrative Court has ruled to revoke the resolution of the EIA expert panel approving the controversial "Giant Military Condo" at Prachanukul Intersection in Bang Sue. The court also declared that the building violates ministerial regulations under the Building Control Act.

In her follow-up post, Ms. Phatsarin highlighted that residents had opposed the project since 2020 during the EIA process, arguing that the land did not comply with the Building Control Act. Specifically, high-rise buildings must be adjacent to roads at least 18 meters wide, yet this condo is located on Soi Prachachuen 30, which is only 12 meters wide. Despite this, Bangkok’s EIA committee approved the project.

She outlined three major concerns:

  1. Questionable EIA Approval: Despite clear legal non-compliance and strong opposition from locals, the EIA report was still approved. The court ruled that the approval lacked thorough examination and disregarded critical facts such as inadequate road access.
  2. Severe Community Impact: The Chuan Chuen neighborhood, home to mostly elderly residents, has endured intense disturbances including construction noise, dust, traffic congestion, limited emergency access, and worsened flooding due to blocked drainage. Once completed, over 40 homes will be cast in permanent shadow, affecting daily life and solar power usage.
  3. Legal Loopholes Favoring State Agencies: While the public must follow all building regulations, a 2007 ministerial regulation exempts government buildings from key construction permits. This creates unchecked privileges for state agencies, leading to potential safety and transparency issues.

Ms. Phatsarin concluded that the legal framework must be overhauled. The current structure gives undue advantages to state entities, undermines oversight, and risks public welfare. This is not just a one-off case but a systemic legal flaw that demands comprehensive reform to uphold accountability and equality under the law.
